We (almost 400 contractual employees in District Gorakhpur, UP, INDIA) are working on contractual basis in MGNREGA UP, Since last 8 Months the district magistrate is not giving our monthly wages, we have approached the DM several times for the payment of salary but he says that our services are not satisfactory and he will not release our dues of 8 Months (Almost Rs 5 Crore ), The Contingency fund generated from the total Expenditure of the district under MGNREGS in the FY 2012-13 is provided to other departments denying our wages, when as per several governments orders the contingency fund should be utilized first to Payment of wages of the contractual staff then anything else...

We have approached him several times and also served him with request letters, but he threatens us that he will terminate our contracts and also threatens us to harass in different ways....we have been working our level best since our appointment on contractual basis and we are not the only persons to be blamed for everything....There are other Permanent government staff responsible for the implementation of the scheme but The DM has never looked upon there responsibilities and they have received their salaries up to date.

We feel helpless and hapless to work in such an environment and highly demotivated bcoz of this.....

What should we do and whom should we approach....please tell us if the higher authorities also deny our rightful wages then what should be the legal discourse.
