Legal Question in Employment Law in India
1. I am an employee under a corporate organisation.
2. I have passed a departmental examination which entails promotion to the higher post along with a financial benefit from the date of my joining in the promotional post.
3. I have been declared passed in the said examination and my name was kept in
the selection panel to be promoted against the future vacancy.
4. By the time the vacancy has arised and my promotion was taken up, the corporation has issued a notice under section-9A of the Industrial Dispute Act, in Form -E with drawing the said financial benefit due to the reasons stated therein.
5. Now the corporation is denying to allow me the financial benefit in view of the notice which was issued after my passing of the examination .
Please examine and advise whether I am entitled for this benefit legally . How the notice under section-9 to be issued and on whom this notice is intended to be issued and the reasons for such issue may please be clarified.
