appraisal not given

Hi,

I was working in an IT company which gave me 20% appraisal effective Sept 2008. but till now they are giving me salary as per my previous offer letter and say that appraised amount will come as arrears. Its been 8 months now and arrears are over 35 thousand but the company has no intention of paying me this amount. I have a written contract paper where it is clearly mentioned that my revised salary is such n such effective sept 2008. Now I have left the company and want to file a case to get this amount recovered. The company says that the appraised amount will be given at the discretion of management. Is that statement justifiable? Plz help

No the statement is not justifiable based on the facts narrated by you. You can consider sending a legal notice through a local lawyer and then if there is no response you can file a case.

No it is not the discretion of the management. They are supposed to pay salary as per the revised. file a recovery case.

You may serve a notice of demand and consider filing a suit for recovery.
