Cancellation of agreement

We are making a hydro Prject. meanwhile, we made an agreement with trade unions regrading increase in salary on hard living conditions of workers. now we, (both trade union & company) wish to cancel the agreement. Please let us know the process to terminate the agreement under Industrial Dispute Act , 1947

Re: Cancellation of agreement

1. I want to know whether there is any clause in the original agreement for cancellation by mutual agreement.

2. If so, both the parties can enter into a fresh agreement cancelling the original agreement entered into duly stating the reasons for wuch cancellation.

3. If there is no clause for cancellation in the original agreement, a fresh agreement may be entered into by both the partities and a clause may be added that the fresh agreement superseeds the earlier agreement and no cancellation of the earlier agreement is necessary.
