Legal Question in Employment Law in India

Contract based jobs

I joined an Indian consultancy in November 2000 as a permanent employee. They had taken a service agreement signed by me and guraranteed by my mother. According to this agreement if I leave them in the first 6 months I should be paying them a sum of Rs.85000/- and if I leave them within 18 months, I should bear all the losses due to the default to the Employer. Now I am working in UK through this company. They are sending me to work with other companies on contract. I now want to leave my current Employer and a join a new organisation. What is that I can do? What is it that my Employer can do?

The company can sue you for breach of Contract if you leave prematurely and you will be liable for damages. Can you send me a copy of the service agreement ?

Re: Contract based jobs

From ur email i understand that u have signed a bond in favour of the employer. As per the contract u have to work for them stipulated period. But u can leave the company stating that they have violated the terms of the contract, for which u need to make some evidence through registered correspondences.there after u can leave the company .but if u leave the company without any reasons u will have to compensate the company for the actual loss caused to the company.but that is a matter of evidence.

u don't have to worry much,if u have a much better offer u can leave after making some corrspondences regarding matters i said above.
