Legal Question in Employment Law in India
Dear Sir/Madam,
I worked for an Company for 5 yrs.
I resigned on 25/6/12 and as per 90 days notice period was ready to work till 22/09/12.
Company asked me to get relieve on 10/08/12 which means I served 47 days of my notice period.
In our contract either of the party has to pay the compensation of 90 days. So as per my knowledge company should pay me the compensation of 43 days.
Please guide.

If your contract says that notice period of 90 days is mandatory failing which corresponding salary is to be paid, then the company will have to pay you the salary/perks for the unexpired period of the 90 days period. Your thinking is correct.
