Legal Question in Employment Law in India

Debit freeze on Salary

Hi, I am an employee at a Pvt. bank in India. I want an opinion from you as I had been on leave for 13 days in the month of May 2007 due to sickness (Leave was sanctioned & Medical certificate deposited). The salary has been credited to my account but there is a debit freeze in my account. I am unable to withdraw any monies from my account. I am also not been assigned any reasons for it. I am attending the office daily and being harassed by my Boss. How can I get my salary now? The bank has also issued me Salary slip but has marked debit freeze on my account. I am sure I am neither a terrorist, money laundrer or im not having any dues etc. Here, I would also like to tell you that there have been many instances as such in the branch where people have ended up leaving their jobs without taking the salary how ever I'll fight till end for my rights.

First thing, make official corrospondence with the bank to relase your account, and also ask them the reason for doing so. If they dont, then file petition or suit to release your account.

Re: Debit freeze on Salary

If the money is debited in your account you are entitled to withdraw the same.Write the bank for release of the account and if the bank fails approach the consumer court as the non releasing of money is deficiency in service.
