Legal Question in Employment Law in India
I am defense counsel in a departmental enquiry.A case has been filed in CBI too and CBI has filed a chargesheet in court. I have heard that there are decisions of Supreme court which say that pending completion of decision of court enquiry should be postponed. This is a unique case where irrefutable evidence to the contrary of charges are available still pressure is on for holding departmental enquiry. My contention is that this way the department will come to know about the line of defense and could benefit in court of law. What should be done.

please mention the name of case law than as it has to be seen in the particular case what ws the reason for holding enquiry and hw that match up to your case.
