can the deposit be refunded?

i,m am working as a software engineer in a mnc.At the time of joining,the company requested me to pay dollar 2700$ for deposit for I.T consultation.and i am working in this company for 2years.now i,m planning to resign from the company.and when i asked about the deposit as no visa processing has been done for me,they said i wont be refunded.presently i have the invoice for the deposit of i.t consultation and the email which they said me to make the deposit and the payment receipt which i made through bank.and now im planning to send an email stating that i,m going to file a case against them by pointing out the laws for deposits.so kindly tell me what all should i include in the email and the necessary law points to be stated.(i heard that for some employees who resigned before 31st march got 54000 rupees when they asked the deposit (for avoiding legal complication.)and when i asked ,they said there is no fund to give you).kindly help me in this matter

You may send them an e-mail, as also a registered A.D. letter, demanding back your money; and may consider eventually filing either a civil suit for recovery or a complaint before the consumer forum. If possible, try to avoid litigation.

I suggest that you should consult a local lawyer with all the documents and since you are going to resign sent your employer a legal notice through an advocate.
