Re: Desciplinary action

Depending upon the type of employee-employer relationship action could be taken against indisciplined employees. You must clarify whether your organization has a standing order for employees' conduct. You can follow model standing order if you do not have one of your own. You must first clearly and precisely state the indiscipline of the employee and issue a memo to the concerned employee and seek his explanation. If the explanation is not satisfactory, you may have to issue a charge sheet to the concerned employee and appoint an independent person as enquiry officer. Principles of natural justice should be followed in the enquiry. Upon receipt of the enquiry report, issue a notice to the delinquent employee with the proposed punishment. You may furnish one copy of the enquiry report also. If the indiscipline proved is of a serious kind, you can terminate the concerned employee. If not a lesser punishment would do. Any how the punishment should not be disproportionate with the indiscipline proved.
