Dilema : Legal opinion
I have been employed with a MNC for last 22 years. About two years back, due to medical problem, I had requested for a change in my role befitting my condition. I was relocated in the same capacity in the field. Due to relapse in my medical condition , I once again made representation to HR , but they have chosen to remain silent. They are now trying to offer me a paltry financial package . They had also called for my medical examination & have chosen to remain silent on the report as well. Kindly let me know, what is my legal position. I do not fall in the workmen category though, there is enough documentation in last two years acknowledging my condition. The company s policy also calls for reasonable accomodation in such matters. I would appreciate ur kind guidance on the above. Thanx

send a representation to the company .. all the persons concerned .. if you don not get any reply... consult a lawyer .. regarding considering the representation

first of all you cannot take them to the courts as the discretion always lies with company and you are binded under the policies of the company.

You make representation to the company with all details.As such at this stage you can not get relief from court of law because it is the discetion of company which depend upon company policy.
