Legal Question in Employment Law in India

dismissal from the service.

My name is--name removed---name removed-- I was employed as a Steno/personal Secretary in Tata Memorial Hospital, Parel, Mumbai-400012. I was active member of the Tata Memorial Hospital Workers Union. The new management did not like my participation in Union Activities. Therefore I was issued a Charge Sheet for misconduct. The Hospital tried to conduct inquiry as per Staff Service Rules. I objected and obtained order from Labour Court to conduct inquiry as per Model Standing Orders which are applicable to me. The domestic inquiry was conducted but it could not prove the misconduct. The Inquiry Officer in the Labour Court deposed that he knows no Model Standing Orders and he conducted inquiry as he was taught i.e. as per Staff Service Rules. The said staff Service Rules are not certified. Out of the 5 allegations, the Inquiry Officer dropped 2 allegations and on the remaining 3 allegations he gave his tailored findings. On such perverse findings, I am dismissed. The case is under trial at Labour Court, Mumbai.

Can you help me to expedite the case? What advice? What directions?

There are some similar cases and all they want legal help. Can you guide us?
