Legal Question in Employment Law in India
I was dismissed from indian railway services in 2001 on the ground of supressing the facts about the criminal case filed on me. A review petition was also rejected and earlier order was continued by railway. In 2008 Criminal court aquited me from the same fabricated case filed on me. Now I have submited a fresh mercy petition to the GM, western railway, along with the copy of aqquital order.
What are the Remidies available for me if the mercy petition is rejected or erlier order is continued ?
Can i move to CAT on rejection of mercy petition ?

You certainly can move CAT. But, it wud depend. In my view, your termination from services was because of the concealment of a fact known to you. It was not because a case was pending against you rather because you suppresed the fact of pendency of a criminal case. However, the cAT may consider a lenient view and grant the relief
