Eligibility for Gratuity
if a person worked for 249 days in the 5th year of his employment in a factory but this 249 days includes sudays and other holidays, is he eligible for payment of Gratuity ?

Consult a local labour lawyer with the details of your case. I believe you would be entitle to gratuity.

It appears prima facie that the workman may be eligible for ayment of Gratuity under the PGA. You may want to contact a labour law consultant with complete facts / documents of your case.
