Legal Question in Employment Law in India
One employee was punished stappage of two increments for two years period.
He preferred an appeal before the appallate authority within specified time limit.
The appallate authority had given hearing on appeal after two years period. During the time the employee had completed the punishment period.
Whether the appeal heard by appallate authority is legal, just or proper ?
Whether any maximum time limit is prescribed in law to furnish such appeals of charge sheeted employees ?

Even if the time period of the punishment has expired , the appeal would be maintainable since it is filed within the prescribed time limit. The time period within which the appeal should be heard depnds upon the respective rules or act under which the appeal is filed . But however, delay in hearing the appeal after the prescribed period will not make the appeal illegal or improper.
