I am a middle level software professional working for a small MNC in Bangalore since last 5 months. I resigned from my current organisation yesterday. Today the boss is telling me that he will not relieve me unless I pay them the money (1.26 lakhs) which they paid the consultant who brought me in. He says I can not leave the organization as its only 5 months and will disturb their project. I have not entered into any sort or agreement while joining nor is it mentioned anywhere in the offer letter that I can not leave the organization within the first 6 months. The notice period on either side is 1 month which I am ready to serve after the resignation. No money as Joining Bonus or in any other form has not been received by me at the time of joining. I request you kindly advice me on my next course of action. Can I approach the court? Is my case strong enough to win? Sugest me some lawyers in Bangalore whom I can approach to get advice. Thanks

It seems that you had not given one month notice at the time of submitting your resignation.Yor employer is exploiting the situation and puttin pressure on you to meet with his illegal demand for which you can not be held responsible.You are merely lible to pay damages in case of your failure to pay one month notice.In case of need you may contact with details for which professional charges are applicable.
