Legal Question in Employment Law in India

Employer not paying salary on time

If the company delays the salary from the date on which they are supposed to disburse it, can an employee take any legal action against it? My company has ''unofficially'' in verbal statement conveyed that the salary would be disbursed by 7th of every month. 3 times in last months the salary has been disbursed on 9th, 14th and 13th of the month. What is the course of action an employee can take against the company?

Re: Employer not paying salary on time

not a big issue; please try to contain your anger so long as you keep receiving what you are entitled for. a court case will complicate things for you - expense, peace of mind and delays.

the employee should stay cool and adjust his schedule of expenses accordingly. should not rush for a legal battle against the employer unless you are pushed to the wall and there is no other alternative. try to cope with the situation. in law, theory and practice are different; it is one thing to have a right; and quite another to enforce it through a court of law. therefore, my advice is : gentleman, hold on.
