Legal Question in Employment Law in India
This is an employment related query. I wanted to know that is an acceptance of an appointment letter considered as a contract and is legally binding. I had joined a firm 11 months back and during salary negotiations they had agreed to a fixed incentive of 50k which has been put under yealry entitlements along with LTA. I left the company in 11 months and they have given me the LTA on pro-rata basis but are not giving the incentive which works out to be Rs. 44 k on prorata basis saying I am not entitled to it till I complete an year. There is no mention of such clause or policy in my appointment letter nor on the employee policy manual they had given me when i had joined the firm. As far as I am aware it has not been written anywhere. They are verbally mentioning it to me and that too now. I want to know whether legally am entitled to the incentive or not? And if yes, then what can I do incase the firm doesnt agree to pay the amount.

It seems to be a genuine problem.
You can serve them a legal notice through a lawyer for recovery of the said amount.
