Legal Question in Employment Law in India

Employment termination

I was employed by HCL Infosystems company wef 04 Aug 2008 at the post of assistant manager HR. The probation time is till 04 Aug 2009.

On 18 Feb 2009 i was conveyed ''verbally'' by my immidiate superior to part ways with the company as '' the company was not getting the viability of my cost''. I feel the step has been taken as the relations with my immidiate superior went wrong due to ''personal'' reasons for past 3 months. My superior has given me time till end of March 2009 to find another job. In my letter of appointment it is given that at any time the company may terminate my employment by giving 90 days notice or 90 days basic salary, the same notice period can be given by me in case i wish to leave the company, my basic salary is only 1/4 of my net monthly salary. I have got my full net salary for month of february and as per our understanding, would be getting for March after full and final settlement. I also do not wish to continue under such superior. What are my full authorizations in such case before I leave the company?

Re: Employment termination

You are entilted to the remaining 60 days basic salary and leave encashment if your appointment letter permits.

Re: Employment termination

It may be better to bring the contract to an end amicably. The dispute, if any, may cause you comparatively more harm.
