EPF(Employee Provident Fund)

I am working in pvt. Ltd. company and our staff is 22.Company has been incorporated in 2005.We dont get any facilities such as EPF and ESI. We all are interested for EPF and ESI facilities. We talked to our employer regarding this.But it seems to me that he is not interested. He is telling us to invest in PPF .His excuse is Starting EPF is very cumbersome on employers part and even after starting this facility a lot of paper work is need to be done on continuous basis in order to maintain accounts and all. In case if employee leaves organisation then transferring his account or closing his account is cumbersome.

I just want to ask you, Does his arguments are justified? Or is he just trying to divert us from EPF demand.Can you please provide me details regarding registration for EPF and how much time it generally takes to register with EPFO. And what are the costs associated with registration process if any.Also tell me is it possible for employer to maintain EPF accounts of the employee through outside agents(SBI bank).

And if you think if he is really giving excuses what legal action can we take against him. Please reply as early as possible.Its urgent. Thanks in advance .Hope I will get answer at the earliest

I believe that your employer is giving excuses. You can consider approaching the EPF nd ESIC commissioner in your area and make representation of your case. He will definitely help you in this matter.

I do not think your employer is making excuses. Since the company and all its employees may be new, he may be skeptical about initiating the process. It may be worth to wait till the things settle down. You are at liberty to approach the concerned officials in the offices of EPF/ESCI.

You may want to seek opinion also from a Labour Law Consultant in your area for appropriate guidance.
