ESI Applicability
Hi,
We are facility management company. We have our own staffs to manage the facility at various sites, all over india. Also, we have sub-contractors to do various services like housekeeping, security etc at sites. All the sub-contractors are having their own ESI registration as their employees are drawing less than 10k and they are maintaining the records/returns regularly. But our own employees in our establishment & site are drawing more than 10k per month as gross. As per ESI act we are not falling under ESI applicability. Now, my question is, as we have sub-contractor under us, at various sites, eventhough ESI is not applicable to us, whether we need to go for registration. Please confirm

in case of higher income - they are not eligible for the scheme.
