Legal Question in Employment Law in India

I am a foreign citizen and i was working in India and getting paid in US Dollars. I recently resigned as i wanted to move back to my country. Before coming to India i was working for the same company in USA. While coming to India i did not receive any deputation letter or a new offer letter.

Once i resigned, they issued me a back dated offer latter (April 2011) that offers salary in Indian currency that is way less than what i was currently getting.

Now they are asking me to pay the difference of amount of Indian Salary and salary they i was in US dollars. What should i do ??? Should I file a suite or should I just ignore as I am not in India or USA. If file a suite where should i file, India or USA ?

Hi,

We would require to peruse the offer letter received by you from the US company.

Prima facie they cannot demand difference from you.

Filing a suit is a last proposition, before that there has to be legal communication with the company with the help of documentation and true facts.

Provide us the scanned copy of appointment letter or any other communication done between you and the company to enable us to opine you accurately.
