Legal Question in Employment Law in India
G was terminated by Pvt. Life Insurance company.G has filed a case in labor court.
Company has not supplied form 16 for period Apr 2009-Mar2010, despite many reminders by email.
G has file return without form16.
Can G lodge a complaint with Income tax Authorities.
If yes to who she should complain and she should lodge a complaint at her location or at HO of company.
What other action can be initiated against the company?
What is penalty in this case.
Kindly advice.

One may complaint to Income Tax for non-receipt of Form No.16. It may be made to Income Tax Office exercising jurisdiction over the Company.
Such lapses are not taken seriously by Income Tax Dept.
