Legal Question in Employment Law in

A Govt.contracted with out stipulating in tender for recovery of labour welfare cess.70% payment was made w/o cess.On 10% work cess was recovered but released on protest.On 20% work cess has been retained.Completion certificate is issued.

Final bill is paid and security released.After one year a demand for total cess is now made.Kindly advise on action to be taken.I understand that this is a free guidance and accordingly this free question

go through the agreement if it is PWD tender than there is a clause for reimbursement of statutory taxes and if other contract go through it as per clause you can recover the tax, no amount of tax is payable to the govt, this on the information given by you facts of each case shall vary
