Gratuity

I am working with a Private Limited company in North India. In our company all employees are eligible for getting gratuity after completing 5 years service with the company after exit from the services. But in our company have a bad practice, that they are not paying to employees whose getting a big/large amount from the authority. They are depositing the amount in Trusty account and transfering in to Company account and utilizing the same funds for other exp. And they are putting some false alligations on employees like Receivebles not collected from the customes, C-Forms not collected from the customers/ etc. Is there any protection to employees for getting their hard earn retairment benifits from company after serving a long periods. Please give guidance to us.

Gratuity belongs to employees and company can not take away this ammount for any reason.you can file complaint with gratiuty commissioner,file case in MRTP commission and also civil suit against company.
