Legal Question in Employment Law in India

Hi,

I'm working for a Listed company in india. My CTC includes some bonus amount which is linked

to Company's performance payable on quaterly basis. I have received the Apr09-Jun09 and Jul09-Sep09 Bonus. I resigned in Feb 2010 and serving 30 days notice period as per company policy. Bonus for Oct09-Dec09 will be paid in February 2010 salary. But since i have resigned, there is doubt whether they would pay me the bonus. Company policy states that, "An employee serving his notice period will not be entitled to any

subsequent salary revision including any benefits that would be applicable

with retrospective effect."

Since this is the bonus and not correction, they have to pay correct?, and in case of non-payment can this be challenged legally? Kindly advice.
