Legal Question in Employment Law in India
Hi
My name is Sameer, Iam in a employment agreement with a US based MNC in Hyderrabad. The contract says I need to serve 30 months otherwise 3 lakh rupees for breach of contract. I was told that I would be given training and guidance for the job but it has been six months and Iam yet to recieve any formal training or inputs from the management. Iam getting frustated with the boredom and not liking it. Moreover I have a guarantor for this agreement and we have submitted three undated cheques 50k each as a surity on the date of joining. Can I break the contract now as I have a better opportunity in hand? Can the employer file a legal case? Wil they harrass my guarantor as well? Can they interfere and spoil my career if I fail to repay the amount?

you have to abide by the contract terms and condition ...as u have agreed to them... moreover u are recving salary for your boredom too... also it was not a condition to continue to work here..
yes legally they can do all that u want....
if u are really not intersted talk to them may they themself, find any good option for u
In the case you leave the company before 30 months, the company can recover the bond amount that is Rs 3 Lakhs. Such amount is in lieu of training cost which the company has incurred on the employee. If the company has not provided any training and nothing has been incurred as cost on you then , they can not demand Rs 3 Lakhs from you. If at all they do so, you have a good case and reply to their demands legally. Dont worry.
