Legal Question in Employment Law in India

i joined a job on 18/11/2008, on the terms of 3 months notice period.

My employer served a notice for trmination of services on 10/05/2010 with salary of 3 months(upto 10/08/2010)

But there is a law of severance pay i.e. if my employer terminates my service within 18 months then I will be eligible for the severance pay.

18 months of service completed on17/05/2010( i.e. from 18/11/2008 to 17/05/2010)

If the date of termination of my service is 10/05/2010 then I will be eligible for the severance pay.

Issue is that what will be date of termination, whether it is 10/05/2010 or 10/08/2010.

Please quote the relevent provisions of law

Your date of termination of service would be 10.5.2010 if the termination on immidiate bases.
