Legal Question in Employment Law in India
I have joined a PSU few months ago. I am seeing that when I am doing an overtime in any day of a week starting Sunday to Saturday and taking a leave( Sick Leave or Earned Leave) in the same week (starting from Sunday to Saturday) then my overtime rate is being paid in less amount than my normal overtime rate. This incident of less payment of overtime is not happening when I am taking a Casual Leave in the same way in place of Sick Leave or Earned Leave. I want to know whether a PSU can do this less payment of overtime rate in case of Sick Leave or Earned Leave (but not in case of Casual Leave) by formulating its own rule of overtime payment or whether this type of less payment of overtime is violating THE FACTORY ACT 1948 regarding payment of overtime.
