my question is that as to whether an employee who has been penalised for his acts and a recovery of loss is to be effected. Partial recovery is effected and thereafter he dies leaving a sum to be recoverable from him, the balance sum can be recovered from the amount payable to his family other than provident fund and gratuity. In the instant case the recovery has been made from the leave encashment payable to the family in the event of death of employee.

What is your query? As such there is no illegality in recovery process.Death of employee does not absolve him or his heirs from liability to pay the due ammount.
