Legal Question in Employment Law in India
Labour Laws - National / Gazetted Holidays Obligation
What are the legal obligations of any private limited company to provide its employees with the Holidays listed as National or Gazetted holidays by the government. If such a company wants to substitute the holiday for a festival to another day, what are the constraints? For example, instead of giving holiday on 'Dhulendi', give holiday to employees on the previous 'Holi' day.

Re: Labour Laws - National / Gazetted Holidays Obligation
Every company has to follw the list of holidays declared by the State Government. However, there are certain days like 2nd October, 15th August, 26h January, etc. which cannot be altered or substituted.
Re: Labour Laws - National / Gazetted Holidays Obligation
The rights and obligations of the parties may be governed by the contract and the local laws,if any. You may also refer to the Shops & Establishment Act, if any, enacted in your State, like the one we have in Punjab.
