Legal Question in Employment Law in India

laws regarding school teaching job

dear sirs

as per govt rules, a Primary teacher(PRT) who is BA+B.Ed is eligible to teach only upto class 5th

a TGT(Trained graduate teacher) upto class 10th and a PGT(Post graduate teacher) upto class 12th

TGT & PGT teachers are to be qualified as BA+B.Ed & MA+B.Ed respectively.and these norms are always followed in govt schools while appointments

however in pvt schools it is seen that PG teachers are appointed even in primary and middle classes which is actually the domain of PRTs and TGTs becoz schools wants to advertise to parents that we have highly qualified staff. whereas the rightful place for PGTs is classes 11th and 12th only.as a result primary and TGTs are rejected

in one interview in a pvt school i was rejected as a TGT for middle class because i have not done MA but only BA Pass+ B.Ed even though lawfully they should hire me in middle classes.in fact i was insulted that i am less qualified!

is this practice by private schools legal?wht can be done?because of this reason i have not got a job yet despite trying for 10 months.

You may refer to the relevant statutory Rules framed by the government regulating service of recognised schools.

such practices are not legal and private schools may lose their recognition if they continue such practice.
