i m ravi jain.I had joined launching pharma company as RSM in 26 July 2010. My immediate boss terminated me within 5 month(probationary period) with the reason of poor performance .termination language was in the view of poor performance in the assignment given to u and indulgence in the activities not in the interest of the company,your service stand terminated with the effect in accordance with the clause 01(b)of the appointment letter issued to u. 1(b) clause was if your work and conduct during probation is not satisfactory,your services will be liable to terminated without notice. after receiving my termination letter I had sent my resignation on same day by evening than they accept after 7 days.the language of resignation is because of my personal reason I am resigning my post I would request you kindly accept my resignation after 15 days of this letter. I didn't request to company to discontinue my termination.entire 5 month even i didn't get target sheet.if i go to labor court than could i get my job back or unfair termination back? i have some q? in my mind( 1.) once company terminated me 0n 14 than how they can accept my resignation after 7 days of my termination.(2) company didn't give me target sheet than how they can terminate me on the basis of poor performance?(3)i have not get any warning letter from company during my probationary period than how my termination is justified? please give me your mobile no. so i can talk to you
