Legal Question in Employment Law in India

Right to be nominee fo GPF

Sir/Madam

My question is my husband has withdrawn money from his GPF account for the marriage of his sister and secondly he has nominated his parents for rest of the amount. Being a wife, I want to know is there anyprovision for wives to be nominee of their husbands GPF account or it depends on the sole decretion of husband decision. Means is women bearing any right to be nominee of Provident fund amount of his husband orelse husband is free to nominate anyone from the family he wants to be.

Re: Right to be nominee fo GPF

You are entitled to be nominee ONLY if your marriage is subsisting and the husband is willing to nomninate.

You have a right of maintenance against husband's income/property and right of inheritance after his death. During his life time, he is entitled to take whatever actions he considers proper. In other words, you cannot appraoch the authorities and demand that you be nominated in their records for the GPF amount or any other benefit. However, after death, you will be entitled to the money/benefits even if someone else is the nominee.

The nominee just has right right to collect and distribute/deliver/assign to the legal heirs.
