Notice period
My Notice period is 3 months and I have already served 2 months out of that. Further I had 40 leaves in credit which I can avail. My employer is willing to sue for not serving full 3 months. Please advice

if you are in continuation of the work you may eligible for leave. but this is the case of voluntarily resignation... your leave credits cannot be used here but you can encash it in your pay! and final settlement!

Leaves are not included as working days of notice,however, you can get the encashment of the leaves.You can be bound to compensate the employer.
