Legal Question in Employment Law in India
Onsite Arrears
I was an Employee of CMC Ltd. for 4 yrs from 02/11/04 till 12/12/08. I was onsite (Florida, USA) from Oct 06 to May 08. This mail is about not receiving arrears in my onsite salary till now, despite repeated reminders to CMC HR and MATC. The follow up that I have done is summarized below.
1. My Grade change had to happen with effect from 1/07/07, after my confirmation; however, this didn't happen even after many follow ups with CMC HR and MATC (Manpower Allocation Team Coor). CMC HR and MATC were aware about the fact that delay in process will result in loss of my onsite salary. 2. Finally, after countless follow ups, my Grade and Salary got updated with effect from 1/09/07. Because of CMC HR and MATC negligence and delay in grade updation resulted in loss of approx. $2600 in my two months' onsite salary. 3. After sending many mails to CMC HR and MATC regarding my onsite arrears, I got a response from MATC, stating that I shall be getting my onsite Arrears and asking me to contact CMC HR. 4. I contacted CMC HR many times over Email, but didn't got any response. 5. After my resignation it was told by CMC HR that I shall get it along with my other dues, which is not happened till now. CMC is now denying to pay onsite Arrears.

You may consider filing a suit for recovery of your arrears.
Re: Onsite Arrears
I believe you should try to resolve this issue amicably with the management. If not possible, you can file a suit for recovery before the competent court.
