Legal Question in Employment Law in India
opted for premature retirement as per agreement but company denies
I was employed by a Multinational Company in 1965.
In the Year 1992, myself on one side and the Company (Multinational) entered into an agreement (i.e, ''Terms of Employment for Officers'')
Section 9 which deals with Retirement states the following:
''The normal age of retirement is sixty yearss but an Officer MAY RETIRE before attaining the normal age of retirement provided if he/she has completed at least fifteen years of continous service in the Company and is not under the age of fifty years on the date of retirement.''
Accordingly, after putting 30 years of service, and at the age of 52, after various oral requests, I tendered my voluntary retirement letter which was turned down by the Management(Note: I am not working anymore). It is not mentioned that the retirement request is at the discretion of the Management.
Kindly enlighten me if I would be legally eligible for the retirement benefits mentioned in the agreement. Please also let me know of any legal remedies applicable to me to argue my case.
