who is Third Party under RTI ?

I need medical status of an staff member working in govt. hospital.

Under RTI His HOD was requested for medical status report of the concerned employee but as the person is suffering from some disease which might be personal (privacy of person) can he be treated as Third party in the case ?

You should confine to your records. The staff member whose records you are asking should make his own application.

You are a "third party" for seeking record of someone else.

You need to show how that record is relatable to you or else how are you affected by any decision taken in his case.

The Information Officer may rightly refuse to provide you information under RTI which is pertaining to a "third party" .
