Legal Question in Employment Law in India

Pay protection

I have joined PSU company(NHPC) with 14 year of experience. At the time of Interview they assured me for pay protection & upon my querry they have given in written that as per the extanct rules my pay will be regulated. My last basic pay was Rs.10200 at HZL(then PSU,Now disinvested by GOI). But upon joining they have offered me initial basic of Rs.7900 and given in writting that as per the extanct rules of corporation my last pay(Rs.10200) can not be protected.Due to this I am incurring the per month loss in earning of Rs. about 8000 and my family dependents suffers a lot. I can not provide quality education to my children.

Please suggest me whether I am eligible for Pay Protection

Re: Pay protection

you have been working in entirely two different institutions. your earlier employment - in no way connected to the present employment and employer! - only the experience - qualification counted! - in you case there cannot be a comparison of your employments - the officals had excatly given you what is possible by the rules they would comply - and they have done it! - in your case, if your employments were same - you can file an application for redressal - minimum wages appellate authority will guide you further! it only an application - that does not require a lawyer! if you want, you can engage one! pay protect applies only to person employed in same/ similar employment with the same employer - all govt. company is not under one single employer in legal sense. for further doubts and quries you can also contact the ministry of labour.
