Legal Question in Employment Law in India

whether PF withdrawal can be made?

I worked with a Bank for 5 years and 5 months and now abroad working for a company. I want to withdraw my PF. But former employer is telling that PF cannot be paid to me but only to my present (new) employer. I have not told them that I am abroad since I did not accept a job for which I initially left this bank job but took up job overseas.

Kindly let me know the provisions to withdraw PF after active 5 years 5 months service.

PF can be paid to you. However, for withdrawal of PF you have to comply with certain procedural issues like filing of forms, etc. The same can be obtained from the HR department of your previous employer. Once the procedure is completed the cheque from the PF authorities will be posted to you house.
