Legal Question in Employment Law in India

My Previous employer has not paid the due salary for 5 months from May 2011 to Sept 2011. I have left the organization in Oct 2011. Thet have given me PAYABLE Payslips and promised that the due salaries will be paid soon, but the given dates are just passing by.

They have not even paid the due Tax to the Income tax dept as well.

What action can I take to make sure that I receive my due salaries and they pay the due tax to the IT department.

Dear Sir / Madam,

You may issue a final written reminder to your previous employer requesting settlement of all your salary dues within 7 days, failing which you will report the matter to the concerned authorities -

1. Local Labour Commissioner for intervention and action against the Company.

2. If you are eligibile for Provident Fund and relevant PF deductions have been made from your salary, a copy of your letter should also be forwarded to the Provident Fund Commissioner for action.

3. Commissioner of Income Tax for violation of crediting Tax Deduction at Source (TDS) dues.
