Legal Question in Employment Law in India

resigning from a job.

I am working with a private limited company in west bengal from June 2008. Till date I have not been provided with any appointment letter or offer letter. Also I HAVE NOT signed on any bond or agreement which says that I have to work for a fixed period of time (e.g 1 or 2 yrs) or that I have give any advance notice before leaving the job. I sign in the staff attendence register as usual. Now under these conditions if I resign from the company without giving any advance notice/information to them can they take any legal step?

Secondly if I send a letter or email informing them about my resignation can that letter or mail be used in any way to take legal step against me?

Please consult your local advocate in respect of the applicability of the West Bengal Shops and Establishment Act for you. If the Act is applicable then you may be governed by the same for notice period.

Your statement may not be complete. However, on the basis of what you have stated, you may be entitled to send a letter / e-mail of resignation and stop attending the job. No legal action may possibly be taken against you in the event of your resigning, unless you have committed something wrong which you may not have been able to express/disclose here.
