Resigning in an IT organization (Information Technology)

Hello,

I work in an IT Firm.

These ppl have a 3 months of notice period which is mandatory to be served. It cannot be bought.

My Questions are:

1. Is this kind of compulsory notice period legal?

2. If a person is forced to stay in the organization beyond his/ her notice period, is this illegal?

(Forcing here means, the HR gives a relieving date of beyond 3 months, forcing him to stay for more than 3 months)

Such notice period are valid and also binding but H.R can not force you to serve beyond three months unless and untill you give cosent for it.Simply give three months notice and thereafter you are entitled to leave the company thereafter.
