Legal Question in Employment Law in India
Getting my salary Dues..
I am working as a senior manager in a private limited company. I am working here for more than 18 months now. The employer who had been funding initially for all expenses (taking all the income), had stopped paying out and my salary is overdue for 4 months now. There had been many who had quit because of salary dues. I wonder if there is any way I (and my colleges) can force my employer to get my salary.
When some fund is received, it is being allotted to some other expenses and salary due is left to accumulate. I do agree that there is a financial crunch. But the problem is the allocation of funds to other expanses and giving a low priority to salary. This boosts up the salary dues and had become really become the worst thing that could happen for all of the employees.
And, if I quit now, would PDCs help in getting my dues settled? (My employer has a history of not honouring the cheques)

If a cheque is bounced, the payee may be entitled to pursue remedies under civil law for recovery of the cheque amount and under criminal law for prosecution of the drawer.
