Legal Question in Employment Law in India
Sir, I am facing a great problem. Please help me by giving me advice. Recently I applied for an executive post in a PSU. The requirement of the PSU was to have GATE score and 65% marks in the B.E. degree. PSU also told final year students of B.E. whose result were pending can also apply. As I have gate score and my final results were pending, I have applied for the said post. Before the interview I gave all my documents of final year examination to the PSU. Our final examination result was given in the way of gradation system by the University not in terms of marks. Based on the gradation I obtained in the final examination I was allowed in the interview. As I qualified successfully in interview I was offered appointment letter and I was told to join in the specified date after being undergone medical test also. Accordingly I did my medical examination and with all my certificates and medical reports I went to join the PSU in the specified date as mentioned by them. But on reaching there when I once again submitted my certificates and medical report, I was told by the PSU that my obtained grade in the final examination did not resemble to the 65% marks as per university norms as they wanted 65% marks in the advertisement. So I was not allowed to join the PSU.
Sir, my question is that I did not hide any documents and submitted my final examination certificates where gradation was mentioned before the interview also, then can the PSU deny my joining after giving me appointment letter?
regards,
Pranjal
