Legal Question in Employment Law in India
Sir, I had joined as Inspector of Customs & Central Excise through SSC exam held in 1990. The result was declared in August, 1991 and appointment letter was given to me in February, 1992. I have been given been seniority for the year 1992. Shouldn't it be for 1991 when the result was declared? Has the order dt. 17.8.04 of Gujarat High Court in NR Parmar case any bearing on this. My OA in CAT on this issue was disposed off by Hon'ble CAT, Principal Bench with the observation that since the issue of inter-se seniority is pending in Hon'ble Supreme Court in NR Parmar case, the matter cannot be decided at this stage.
