Legal Question in Employment Law in India
Sir, please help us to meet our query.
we are working in a psu. we have total eight grades in staff level. recruitment is being done in grade-iii & grade-iv for which qualification is same but for grade-iv only experince is required. one of my friends was recruited in grade-iii through a recruitment process in 2009. later he competted for a recruitment process in grade-iv in 2010 and got selected with many others fresh candidates. all other fresh candidate were allowed to join the organisation in december 2009 & january 2010 but he was offered joining letter in june 2010 and was allowed to join in june 2010. later he was given seniority from 09.12 2009 as per merit list (09.12.2009 was the first fresh candidate joining date). but his pay was fixed much lesser than the all fresh candidates even who join in january 2010 (all fresh candidates� seniority was given corresponding to their date of joining).
my query is whether such activity ( fixing lesser pay & giving offer letter late though he was in the upper posision in the meril list ) of our management is justified?
if yes, on which gound?
if no, what is the explanation behind it and what is remedy of it?

You may approach the High Court under a writ petition for you griviances.
