Hello sir, i have a question regarding my notice period, my notice period says "your employment contract may be terminated by either party giving 2 month's notice or in the absence of such notice by paying 2 month's salary to the other party" i am ready for the buyout option but my HR is saying that this option works when the manager is ready to relieve you"

1. is she right?

2. how to handle this type of situation as our company acquired by MNC company and in the letter given by them this thing is mentioned.

3. should i approach to other higher level management means the MNC's management team ?

You can quit by tendering two months salary. If you have resigned in terms of the contract of appointment , the HR cannot insist on the manager relieving you.You may inform in writing once again the date from which you shall not be attending to work.
