Legal Question in Employment Law in India

Sir, i am a software professional and working in a KPO and as per the letter which i have received from the company after my appraisal in that letter it has clearly mentioned that you have to serve one month notice period after that i got permoted and i got the permotion letter in that letter there is nothing mentioned in terms of notice period extended, it has just mentioned that you effort has been recognised and you are being permoted to the new level and terms and conditions will be applicable as per the new role and now issue is that i have got the new job in some other company and i have resigned with 30 days notice period as per my documents but HR says that you have to serve 60 days notice period as the policy have got changed otherwise you will be marked as Absconding in the company records and your releiver & experience letter will not be provided and so is the full final settlement, so kindly suggest me the best way to outcome from this issue, i would be really gratefull to you.

Thanks,

Shishupal

Hi,

If the period of 30 days is mentioned as notice period in the appraisal letter and not 60 days then the company can not force you.

To advise you better the documents received and signed by you needs to be perused properly.
