Legal Question in Employment Law in India

Hello sir,

i am rahil hr from bangalore.

I have worked for company as an associate consultant for a period of 21 days because the employers removed me and that to with out giving a valid reason.

And they had told me that they will be issuing the salary with in 3 working days.

But still now i havent recieved it if i call them they tell me that the salary has been dispatched from there consultancy thats in mumbai it will be credited to your account with in 72 hrs.

But still now i havent recieved it. and they are also not paying me 4 days of salary because they havent sent the correct attendence sheet to the consultancy but when i visited the company 3 days before and asked them to show me the attendence register they did not let me to see it but some i managed to check it and found that i have 21 days of attendence and i even told them them about it they told me to come on saturday thts today but when i went thr today they have told me to come on monday. i cant travel there every day becoz its 25 kms away frm here and it costs me a lot too.

already 30 days have gone and the way they are talking i dont think so they will issue my salary.

I even have the appointment letter with me.

can i take any legal action against them

and if they pay me 4 days less salary what should i do and i even have the photo copy of attendence sheet which is clearly of 21 days.

and can i take an action on them because they havent informed me for my termination and that to with in 1 month of time.

please help me with these for which i'll be very grate full to you...

Dear Rahul,

I read the facts stated by you. I felt very sorry. This is the hire and fire wave going on in private companies. Dont leave these people scott free. I would like to advice you in this situation. Before filing any suit against the company. you need to collect some more information. as you told u have the offer letter and the photocopy of the attendance sheet. along with these you somehow get the bank transaction ID related to the salary amount of which the employer tells you that he had credited and the bank name. Do you have salary account created by the employer. Also take some printouts of the emails conversations which you had with the employer from inside and outside the company. After collecting all these information, appoint a lawyer and give a notice to your employer. Also take consultation of your lawyer and proceed.
